The independent contractor issue is getting more pressure and press for Uber, and many other companies.  The Department of Labor is looking into the classification of independent contractor vs employees.

The Department of Labor has rules in place and they are not new, the guidance is supposed to clarify and warn companies like how not break the rules.

The following are the six factors that the Supreme Court deemed significant for guidance:

  • Is the work an integral part of the employer’s business?
    • What are the worker’s opportunities for profit and loss?
    • How much has a worker invested compared to a company?
    • Does the work performed require special skills?
    • Is the relationship between the worker and employer permanent or indefinite?
    • What is the degree of the employer’s control?

This will be continue to be an issue, in spite of the fact that government is making it ever more expensive and complicated to have employees with a small business or a start-up.
